The US Justice Department has renewed its efforts to gain access to federal jury documents from the investigation into Jeffrey Epstein, which resulted in his criminal charges in 2019.
The newly submitted petition, signed by the federal prosecutor for the Manhattan district, asserts that legislators made it evident when approving the disclosure of investigative materials that these court records should be unsealed.
"The lawmakers' decision took precedence over standing rules in a manner that enables the release of the federal jury documents," stated the government lawyers.
The filing petitioned the district court to proceed quickly in unsealing the materials, pointing to the 30-day window established after the bill was enacted last week.
However, this new effort comes after a prior petition from the Trump administration was rejected by the presiding judge, who cited a "important and persuasive factor" for preserving the documents under wraps.
In his summer decision, the magistrate commented that the 70 pages of jury testimony and evidence, containing a PowerPoint presentation, communication logs, and letters from survivors and their lawyers, seem insignificant beside the federal extensive repository of case-related materials.
"The government's massive collection of case documents overshadow the approximately seventy pages," noted Berman in his ruling, observing that the request appeared to be a "detour" from disclosing records already in the prosecution's control.
The grand jury materials mainly include the statement of an FBI agent, who served as the only witness in the grand jury proceedings and reportedly had "little firsthand information of the facts of the case" with testimony that was "primarily secondhand."
The magistrate pointed to the "possible threats to affected individuals' protection and personal information" as the persuasive factor for preserving the materials under seal.
A parallel motion to make public sealed witness accounts relating to the criminal proceedings of his associate was also turned down, with the magistrate stating that the prosecution's motion incorrectly suggested the confidential documents contained an "unexplored treasure trove of undisclosed information" about the proceedings.
The current motion comes shortly after the designation of a new prosecutor to probe Epstein's relationships with well-known politicians and a few months after the dismissal of one of the principal attorneys working on the proceedings.
When asked about how the ongoing investigation might influence the release of Epstein files in federal custody, the chief law enforcement officer commented: "No further statements will be made on that because it is now a pending investigation in the New York district."
